Tougher tobacco laws now in force for commercial premises

South Australian businesses should be aware of new laws in effect from 5 June 2025, targeting the illegal trade in tobacco and vapes and changing the rules around commercial leases.

The updated laws give Consumer and Business Services and SA Police stronger powers to crack down on illegal tobacco activity. 

Key changes include:

  • New closure powers: Authorities can issue short-term closure orders (up to 28 days), and long-term orders can now last up to 12 months with court approval.
  • Lease termination rights: If a premises is hit with a long-term closure order, either the landlord or tenant can terminate the lease with at least 28 days’ notice (or sooner if agreed).
  • Dispute resolution: The Magistrates Court can resolve lease disputes linked to closure orders, including awarding compensation.
  • New offences: Landlords or agents who knowingly allow illegal activity can now be penalised, as can people found on a premises during a closure order (some exceptions apply).
  • Improved information sharing: Authorities can now share more details with landlords, building managers and the public to support enforcement efforts.
  • Tougher penalties: New regulations define commercial quantities of illegal products that attract the highest financial penalties in Australia.
