Flexible Work Arrangements: Understanding your obligations as an employer

South Australian businesses are operating in a changing environment, with growing interest in flexible working arrangements across many workplaces. Understanding the rules and approaching conversations early will be key.

For office-based roles, employers and employees are encouraged to have open, practical discussions about flexibility where it is reasonable and can be accommodated. While working from home is one option, flexibility can take many forms, including adjusted start and finish times, condensed working weeks, part-time arrangements or temporary changes to hours.

Not every role will suit every type of flexibility, and the legislation recognises that balance.

When considering requests, businesses should weigh factors such as the nature of the role, whether duties can be effectively performed remotely or under alternative arrangements, IT capability, and the operational impact on the business. Personal and financial circumstances may also be relevant in assessing reasonableness.

Importantly, employers are not required to approve every request. Under the Fair Work Act, flexible work requests can be refused on reasonable business grounds, including significant cost, capacity constraints or impacts on productivity. Where a formal request is made, employers must respond in writing within 21 days.

Clear communication remains critical. Employers are encouraged to consult with their teams early, outline expectations clearly, and explore practical options that work for both the business and the employee. Taking a considered and compliant approach will help minimise the risk of disputes and ensure businesses meet their workplace obligations.
