Don’t get caught out advertising jobs illegally

Did you know that last year the Fair Work Ombudsman (FWO) was given powers to issue fines to employers who were posting job ads which advertised rates of pay that were below the national minimum wage or below the appropriate Modern Award rates? 

The FWO have issued 151 infringement notices to employers since March 2023 when they were given these new powers. The FWO has made it clear that they are routinely searching public job advertisement platforms, such as Seek, and contacting employers who are illegally advertising jobs. The FWO are taking an educational approach when contacting employers however they are also issuing Infringement Notices which results in fines for employers.

Before you proceed with advertising a job, it is crucial that you ensure that the rates of pay you are containing in your job ad are correct.
