With the Australian Government extending the temporary JobKeeper Payment to 28 March 2021, eligible businesses must now meet the turnover test and submit their declaration by the 14th of each month.
Under JobKeeper 2.0, there will be two new repayment rates: one for those who work more than 20 hours per week in the relevant period and another for those who work less.
The employee eligibility date has also been changed to 1 July, meaning some businesses could claim for more staff.
Legacy employers are those employers who qualified for JobKeeper 1.0 prior to 28 September 2020 who do not qualify for JobKeeper 2.0 but are still able to show at least a 10 per cent decline in turnover.
Legacy Employers can access SOME modified workplace law flexibilities for their employees who previously received JobKeeper.
Legacy employer MUST obtain a 10 per cent decline in turnover certificate/self-certify for each subsequent quarter to continue to be eligible to continue to use the Fair Work Act flexibilities.
A direction/request automatically ceases to lawfully operate if an employer does not obtain the relevant certificate each quarter.
