The Attorney-Generals’ office have released a consultation paper highlighting the need to amend the current Fair Work Act to support small business owners and workers. With high-profile organisations such as Wesfarmers and Woolworths embroiled in underpayment actions, the Prime Minister has tasked the Attorney-General — in his capacity as Minister for Industrial Relations – to undertake an investigation of existing legislation.
There is currently no level playing field for employers, as most business owners trying to do the right thing are competing against those that deliberately underpay or exploit workers. This punishes businesses who are compliant and reduces competitiveness. To remedy this, the Fair Work Act update will send a strong message of deterrence to would-be lawbreakers by implementing enforcement tools including significant jail terms and higher fines.
