IR laws pass the Federal Parliament

On Monday, February 12, the Australian Senate and House of Representatives jointly passed the Fair Work Legislation Amendment (Closing Loopholes No.2) Bill 2023.

This significant legislative development, now awaiting royal assent, heralds substantial industrial reforms for Australia.

  • Employees’ right to disconnect and not respond to their employer after or outside work hours
  • Employee’s rights to challenge unfair contractual terms
  • Casual employment will be defined differently with a new right of conversion
  • The definition of employment will change.
  • Development of enterprise agreement model terms by the Fair Work Commission
  • Transitioning from multi-enterprise agreements

The South Australian Business Chamber has been working with state counterparts across Australia, and its national body the Australian Chamber of Commerce and Industry to attempt to secure the best possible outcomes for employers, as this legislation has made its way through the Parliament.
