The State Parliament has passed a Bill to extend leasing protections for commercial tenants until 6 February 2021.
The South Australian Business Chamber recently surveyed members on this topic and the majority sought an extension to both the eviction restrictions and broader aspects of the Commercial Leasing Code beyond 28 September.
However, many members also commented about the need to distinguish between protections for tenants with and without material pre-COVID arrears.
The extension of the COVID-19 Emergency Response Act 2020 rolls over the existing commercial leasing arrangements, with a clarification around a landlords’ power to take prescribed action against a tenant for a breach of a lease while not being classified as an affected lessee (i.e. eligible for JobKeeper and under the $50m turnover threshold).
