Historically the coverage provisions in the Miscellaneous Award 2020 may not have been applicable to your business and your award free employees. However, from 1 July 2020 the Miscellaneous Award 2020 has been expanded to cover some employees who were not previously covered by an award. Some roles were previously excluded from the coverage of the Miscellaneous Award 2020 because they were not covered by the classifications in the relevant industry award. This meant they were award-free and therefore not entitled to additional remuneration when working overtime, unsocial, irregular or unpredictable hours, weekends, public holidays or shifts.
If you employ low skilled, semi-skilled or trade qualified employees, who were historically award free, it is important that you review this decision to determine if they are now covered by the Miscellaneous Award 2020. For example, if your business is not covered by an award and you privately hire a security guard or cleaner, this role may now be covered by the Miscellaneous Award 2020. It is important to get this right as failure to do so may result in potential underpayment claims.
This decision comes into operation from the first full pay period on or after 1 July 2020.
